About Michigan Auto Accident Claims

Michigan requires plaintiffs to meet an accident threshold to sue a third party for injuries in a motor vehicle accident. The victim must suffer (a) serious impairment of a body function, (b) permanent disfigurement, or (c) death. Serious injuries are recoverable as are permanent and catastrophic injuries, such as loss of limb, brain damage, or paralysis.

State law also imposes a time frame (statute of limitations) to file a lawsuit for damages:

  • Car accident victims have three years to bring a suit against the other driver or entity whose negligence led to the accident (third party).
  • If your own insurance carrier (first party) will not pay your rightful damages (such as lost wages, property damages, or medical expenses), you have one year from the date of the accident to sue your insurance company.
  • If the other driver had no insurance or not enough insurance coverage to fully compensate your losses, claims can be filed against your own Uninsured or Underinsured Motorist policy. Please note, hit and run accidents will result in claims being filed against your Uninsured Motorist policy.
